User Fruct Agreement

Imagine a foreign couple who owns a property in Spain. In their respective wills, both agree that the children inherit the “simple property” of their half of the house and that the partner obtains the usufruct for life. Therefore, after the death of one of them, the children would inherit 50% of the property. It is important that the heirs understand here that they cannot use it, rent it, live there, because the surviving parent now has 50% of the property and also the exclusive right to use and enjoy the other 50% during his lifetime. While Georgia Louisiana does not share civil history, the General Assembly of Georgia created the legal usufruct. [9] In Georgia, usufruct is “rights or privileges that normally arise from the relationships of landlords and tenants and with privileges granted to tenants who, for years, are less interested in real estate than in real estate.” [10] Under Georgian law, a lease is a usufruct when a landowner grants a lease of less than five years, and the landowner retains the property. [11] In addition, Georgian courts consider any relationship between a landowner and a tenant to be a usufruct when the restrictions are “so widespread that they have been fundamentally incompatible with the concept of succession for years” or if the landowner retains “dominion and control” of the activity on the land. [12] Fruits refer to any renewable product on the land, including (among others) actual fruits, livestock, and even rents from the property. These can be subdivided into civil fruits (fructus civils), industriels (fructus industriales) and natural fruits (fructus naturales), of which in Roman law included slaves and livestock. In Thailand, the Commercial and Civil Law Code is based on the European Civil Code and recognizes the concept of usufruct in clauses 1417 to 1428.

The usufruct can be carried out for life or at most 30 years according to the law. It must be registered with the local rural department to have full effect on third parties, on the Nor Sor Sam property deed or more.
